After hearing learned counsel for the parties for some time, learned counsel for petitioner, on instructions, resiles to a situation, wherein he would explore possibility of making another application at appropriate stage of the matter, as application Exhibit - 42 in special civil suit no. 33 of 2013 had been moved at a premature stage, which was rejected, against which present writ petition is preferred. He, thus, does not press present writ petition and seeks leave to withdraw the petition with liberty. 2.

Learned counsel for respondent, on instructions, does not have any particular objection.

In view of the same, leave granted. Writ petition is disposed of as withdrawn without undermining petitioner's application at appropriate stage.
