The petitioner is reduced in rank. The same would be within Rule 102 of the Maharashtra Agricultural Produce Marketing (Development and Regulation) Rules, 1967. It is also submitted that the recovery is claimed from the petitioner.

We have heard the learned A.G.P. also.

The petitioner may file an appeal as provided under Rule 104 of the Maharashtra Agricultural Produce Marketing (Development and Regulation)

2 wp 7134.19 Rules, 1967 within a period of 15 days from today. The recovery pursuant to the impugned order shall not be claimed from the petitioner for 15 days so as to give opportunity to the petitioner to avail the remedy of an appeal. In case, the petitioner files an appeal, all contentions of the parties are kept open.

The writ petition is accordingly disposed of. No costs.
