DATED : 6th JULY, 2015 ORDER :- Heard Shri S.S.Thombre, learned counsel for applicant and Shri Mote, learned A.P.P. for respondent State. 2] By present application, applicant is seeking anticipatory bail in Crime No.55/15 registered with Bori police station, Tq. Jintur, Dist.Parbhani for offences punishable u/s 326, 323, 504, 506 r.w. 34 of I.P.C.

3] From the investigation papers, it is clear that initially offence was registered by present applicant against Munjaji who is first informant in Crime No.55/15.

criapln3066-15 -24] Present applicant was first informant in Crime No.54/15 for offences punishable u/s 326, 323, 504 of I.P.C. and u/ 3(1) (10) of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act. This Court has called the investigation papers of Crime No.54/15 also. Those papers show that the present applicant received Contused Lacerated Wound. On his scalp on the left parietal region which admeasures 6x1x1 cm. And also contusion of the left hand which admeasures 4.2 cm and the contusion on the left shoulder admeasuring 3x2 cm. That shows that the present first informant was aggressive. It is reported that present first informant was already arrested in the crime registered against him by present applicant and he released on bail.

5] Looking to the nature of the injuries suffered by Munjaji who is the first informant, in which applicant first claimed bail are simple in nature and custodial presence of the present applicant is not warranted. In view of this, Application is allowed. Interim relief granted on 17/6/2015 stands confirmed. (V.M.DESHPANDE,J.) umg/
