Learned advocate for the petitioner, on instructions, seeks leave to withdraw the writ petition, with liberty to prefer a revision against the order which is a composite order, firstly, condoning the delay and secondly, admitting the appeal, purportedly passed under Section 251 of the Maharashtra Land Revenue Code. He submitted that by virtue of Section 252 since the order admitting the appeal is not appeable, he would prefer a revision to the extent of condonation of the delay, however, the petitioner would need some breathing time as the learned Sub Divisional Officer is in haste to decide the appeal. He submits that a long delay of more than 13 years has been condoned. 2.
The Writ Petition is dismissed as withdrawn with liberty as prayed for. Time of two weeks is granted to the petitioner to resort to the appropriate revision and only till then there shall be stay to the further hearing of the appeal before the learned Sub Divisional Officer.
