After this Court has shown its disinclination to entertain the application of applicant No. 1 Somnath Rohidas Bhosale, learned counsel, on instructions, seeks leave to withdraw the application. Application stands dismissed as withdrawn qua application No.1-Somnath. 2.
Applicant Nos. 2 and 3 are aged about 73 and 75 years respectively. Perusal of the first information report shows that though their presence has been shown, there were no any weapon in their hand like co-accused. It is alleged that these applicants assaulted informant with kick and blows.

Prima facie perusal of the material collected during the investigation till date does not show that offence punishable under Sections 326 and 324 is attracted against present applicants. Having regard to their age and considering alleged role against them in this 947.aba831.23.odt
crime, their liberty deserve to be protected. Hence the order.
ORDER
(i) Application of applicant No.1 is dismissed as withdrawn. (ii) In the event of arrest of applicant Nos. 2 and 3 in connection with CR No. 301/2023 registered with Shevgaon Police Station, Dist. Ahmednagar for the offences punishable under Sections 326, 324, 452, 143, 147, 148, 149, 323, 504 and 506 of the IPC, they shall be released on bail on furnishing PR Bond of Rs.15,000/- each (Rupees fifteen Thousand only) with one solvent surety in the like amount. (iii) They shall not contact the witnesses directly or indirectly.
(iv) They shall not interfere with the evidence in any manner whatsoever.
(v) They are further directed to cooperate the Investigating Agency for further investigation.
