The petitioner is disqualified on the ground that the petitioner has third child born after the cut-off date. Mr.Karpe, learned Counsel for the petitioner, submits that the petitioner has filed an appeal along with stay petition before Respondent-Divisional Commissioner.

We have heard learned Additional Government Pleader for Respondents No.1, 3 and 4. In case, stay petition has been filed by the petitioner in an appeal before Respondent No.3-Divisional Commissioner and if the same is pending, Respondent No.3 shall decide the stay petition on its own merits after hearing the parties before 21st June, 2019.
