The learned Advocate for the appellant alongwith the officer of New India Assurance Company and the learned Advocate for the respondent are present. The parties have amicably settled the matter. They have placed on record the terms of settlement which is marked as Exhibit-X. 3.

We have verified the terms of settlement. The parties are ready to settle the claim in terms of settlement which is marked as Exhibit-X. The appellant/New India Assurance Company has already deposited the compensation amount in this Court. The respondent/claimant is entitled to an amount of Rs. 23,00,000/-

NOB-FA-1409-2022 -2towards full and final settlement which is already deposited in this Court. The appellant/ New India Assurance Company is entitled to withdraw the balance amount alongwith interest. 4.

In view of the terms of settlement at Exhibit-X, the appeal stands disposed of.

The respondent/claimant shall be at liberty to withdraw the amount Rs.23,00,000/- towards full and final settlement. The appellant/ New India Assurance Company shall be at liberty to withdraw the balance amount alongwith interest which is deposited in this Court.

The Court fees be refunded as per rules.

Award be drawn up accordingly.
