For the reasons stated in the application, the application stands allowed in terms of prayer clause - 'B', 'C' and 'D'. Necessary amendment be carried out within a week. Since the present application is filed by the legal heirs of deceased respondent No.12, no separate notice is now required to be issued in the Second Appeal.

Learned counsel Shri Bhide is appearing for legal heirs of respondent No.12. His name be recorded in Civil Application and Second Appeal.
