Heard learned counsel for the applicant and learned APP for the State.

The applicant is seeking bail in Crime No.31 of 2023 registered with Nanalpeth Police Station, District Parbhani for the offence punishable under Section 302, 304, 341, 143, 147, and 149 of Indian Penal Code.

The alleged incident happened four days before the knowledge of the death of the deceased. However, the report of the said incident in which the deceased was assaulted was not given. The CCTV footage barely indicates that the accused were passing through the road. The so-called witness has been examined belatedly. The incident appears to be happened in the spur of moment. No deadly weapons have been recovered from the applicant. The charge sheet

936-ba-905-2023.odt (2) has been filed. There are no antecedents to his discredit. Considering the facts and circumstances of the case and the delay in lodging the FIR, the Court is of the view that the applicant deserve bail. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Syed Imran Anwar s/o Syed Gausoddin, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that he shall not tamper with the prosecution witnesses.

(iii) The applicant shall attend the trial on each effective date. (S.G. MEHARE, J.) Mujaheed//
