Heard learned counsel for the applicant and learned APP for the State.

The applicant is seeking bail in Crime No.355 of 2022 registered with Pimpalgaon Hareshwar Police Station, District Jalgaon for the offence punishable under Section 302, 326, 324, 323 and 504 of Indian Penal Code.

The applicant is 78 years old having no antecedents to his discredit. Considering the role attributed to the applicant and the way in which the incident happened, the Court is of the view that he may be released on bail. It is clarified that considering his role, he has been granted bail. Hence, the following order :

ORDER

(i) Bail Application is allowed.

927-ba-914-2023.odt (2) (ii) The applicant, Prasad Motiram Bhosle, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that he shall not tamper with the prosecution witnesses.
