Mr.Deshmukh, learned counsel submits that in fact, the petitioner ought to have been appointed as a Medical Officer. The said post at the relevant time was class III post. The petitioner was possessing necessary qualification. As the petitioner was in need of the job, the petitioner accepted appointment as a Senior Clerk. The application of the petitioner is pending. The Respondent be directed to consider the application of the petitioner for appointment as Medical Officer.

Mr.Patil, learned Addl. Govt. Pleader submits that the post of Medical Officer is Class II post and the same can not be filled in by compassionate appointment.

As it is submitted by the learned Addl. Govt. Pleader that post of Medical Officer is Class II post and the same is not available for appointment on compassionate ground, the case of the petitioner can not be considered.
