wp6081.15 -1-
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 6081 OF 2015 GANESH BHARAT WALZADE
VERSUS
THE STATE OF MAHARASHTRA AND ANOTHER ...
Advocate for Petitioner : Mr. Mundhe Shrimant AGP for Respondents: Mr. K.G. Patil .....
CORAM : S. V. GANGAPURWALA AND V. K. JADHAV, JJ.
DATED : 22nd JUNE, 2015 P.C. :- 1.
Learned A.G.P. raises preliminary objection that the petitioner has alternate remedy before the Maharashtra Administrative Tribunal.
2.
Learned counsel submits that in identical case, the Division Bench at the Principal Seat at Bombay has admitted the writ petition. 3.
Only writ petition has been admitted. It does not appear that the objection raised by the learned A.G.P. was considered in the said writ petition.
wp6081.15 -24.
In the light of that, though Mr. Mundhe learned counsel for the petitioner seeks to canvas the submissions on merits, we are not inclined to consider the same. Writ petition is disposed of with liberty to the petitioner to avail alternate remedy. All contentions are kept open. No costs.
