1] Heard learned counsel for the applicant and the learned APP for the respondent-State.
2] The applicant is apprehending arrest in connection with Crime No. 67/2024, registered at Murud Police Station, District Latur, for the offences punishable under sections 406, 420, 463, 464, 467, 468, 469, 472, 191 of the IPC.
3] The learned counsel for the applicant submits that the complainant is the Vice President of the Murudeshwar Devsthan Trust and the allegation against the applicant is that the applicant has utilized the funds of the
said trust posing himself as President of the trust. The learned counsel further submits that this Court, by order dated 12th June, 2024, has granted interim protection in favour of the applicant and in terms of the said order, the applicant has attended the concerned police station and has co-operated with the investigation. The learned counsel further submits that the complainant had filed an application for inquiry so also the Assistant Charity Commissioner had proposed similar inquiry on the basis of which the Joint Charity Commissioner had initiated suo moto inquiry under Section 41D of the Maharashtra Public Trusts Act against the applicant for mis-utilization of funds of the trust by the applicant. By order dated 28.11.2024, the Joint Charity Commissioner has dismissed both the applications filed under Section 41D of the Maharashtra Public Trusts Act.
4] In view of above order of the Joint Charity Commissioner and in terms of interim order dated 12th June, 2024, the applicant has attended the concerned police station and has co-operated in the investigation and also considering the fact that prima-facie the allegations made are civil in nature, the interim protection granted by order dated 12.06.2024 stands confirmed, on the following terms :
i] The applicant shall attend the concerned police station as and when called by the investigation officer.
ii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case.
iii] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court.
5] In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled.
6] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
7] The application stands disposed of.
