(VACATION COURT) Dated : 05th June 2025 ORDER [PER COURT] :- 1.

The applicant seeks enlargement on regular bail on account of his arrest in crime bearing No.0186 of 2025, registered with Kaij Police Station, Dist. Beed, for the offences punishable under Sections 3, 4, 5, 6 of The Immoral Traffic (Prevention) Act, 1956 and Section 143 of the Bharatiya Nyaya Sanhita, 2023.

Learned counsel for the applicant pointed out the report in which it is averred that the applicant is a Manager of Mahalakshmi Loknatya Sanskrutik Kala Kendra, Umri Shivar, Tq. Kaij, Dist. Beed. It is alleged that he and two other accused trafficked ten adult young girls and engaged them in sexual exploitation at said Kala Kendra for commercial purposes from which he derived income. Accordingly, decoy customer and panchas were called for effecting a raid. The decoy customer was handed over with an amount of Rs.5,000/-. 3.

On 24.04.2025, they and police personnel went to the said Kala Kendra. The decoy customer met with the applicant. The applicant demanded an amount of Rs.5,000/- to him to have a sexual intercourse with sex worker and directed him to go to room No.4 to meet the sex worker employed by the applicant. Accordingly, he went there and met with sex worker there. He sent message to the informant Madhusudan R. Ghule, ASI of Kaij Police Station, Dist. Beed and accordingly, the raid was thereafter effected. The informant seized Rs.5,000/- from the applicant. One woman was present in room No.4. She told her name and age to be 29 years. She also told that she was engaged by the applicant in the said business. The report was lodged and crime was registered against the applicant and other two who were running that Kala Kendra. The applicant was arrested.

Learned Advocate for the applicant submitted that the practical investigation is over. Trial will take long period. The applicant has roots in the society. He has no criminal antecedents. He will not flee away from the trial. It is lastly prayed to allow the application.

Learned APP strongly opposed the application and prayed to reject the application as the investigation is not over. He submitted that the applicant is involved in the serious crime and if he is released on bail, he will commit similar crime again and therefore, prayed to reject the application.

Perused the papers of investigation. Papers of investigation show that the statements of witnesses are recorded and spot panchnama is drawn. An amount of Rs.5,000/- is seized. The practical investigation is over. The custody of the applicant is not necessary for further investigation. The applicant has roots in the society. He has no criminal antecedents. He will not flee away from the trial. Trial will take long period. The application, therefore, deserves to be allowed. Hence, the following order.

ORDER

I) The application is allowed.

II) Applicant Mayur S/o. Baburao Andhare, be released on bail in connection with crime bearing No.0186 of 2025, registered with Kaij Police Station, Dist. Beed, for the offences punishable under Sections 3, 4, 5, 6 of The Immoral Traffic (Prevention) Act, 1956 and Section 143 of the Bharatiya Nyaya Sanhita, 2023, on executing P.R. Bond of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount.

III) The applicant shall not tamper the prosecution evidence and pressurize prosecution witnesses.

IV) The applicant shall attend the concerned police station as and when called by the Investigating Officer. V) The applicant shall not get involved in similar crime. VI) Bail before the trial court.
