Learned counsel for the petitioner submits that the respondent has complied with the order. Initially the respondent was not inclined to comply with the order of the Court. He had filed affidavit mentioning therein that it was not necessary to remove the encroachment. After six months he removed the encroachment. This conduct of the concerned officer needs to be deprecated.

Learned AGP Shri. Jadhavar defends the action of the officers contending that there was stay granted by the Civil cp307.21

Court. Therefore, the authorities could not comply with the order of this Court.
