Heard the learned counsel for the petitioner, learned A.G.P. for respondent Nos.1 to 4 and the learned counsel, who had earlier filed vakilpatra on behalf of deceased respondent No.5. 2.

The controversy is in respect of challenge to the order dated 07/11/2010 passed by respondent No.2 in Revision Application and the order dated 25/05/2012 passed by respondent No.2 in Review Application, related to kerosene licence in favour of the petitioner as well as deceased respondent No.5.

The learned A.G.P. tenders across the bar a communication dated 11/03/2025 issued by the District Supply Officer, Nandurbar. The same is taken on record and marked as 'X' for identification purpose. By referring to this communication, it is

5690.12wp (2) pointed out that the District Supply Officer, Nandurbar has informed that, in view of supply of free cylinders in the Nandurbar District, the demand for kerosene supply has come to an end and there is no question of distribution of kerosene in the Nandurbar District. In view of this, it is submitted by the learned A.G.P. that the instant petition has become infructuous and the same may be disposed of. 4.

Learned counsel for the petitioner submits that kerosene licence in the name of the petitioner is renewed till 31/12/2027 and although there is no distribution of kerosene, however, he is entitled to carry on business as and when the distribution is allowed. He, therefore, seeks liberty to allow him to carry on distribution on the basis of his existing licence as and when it is possible pursuant to the policy of the Government. He seeks liberty to initiate appropriate proceedings in case the distribution is started. 5.

In view of the communication 'X' dated 11/03/2025 (supra) issued by District Supply Officer, Nandurbar, the instant petition is disposed of with liberty to the parties to raise appropriate grievance regarding quota, if at all distribution is started in future. (PRAFULLA S. KHUBALKAR, J.) sjk
