This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0319/2019, registered with Pundlik Nagar, Aurangabad, District Aurangabad, for the offence punishable under Sections 120-B, 314, 203, 201 of the Indian Penal Code. 2.

Heard.

Perused the First Information Report (FIR) and the related police papers.

The learned Advocate for the applicant has asked for bail on the ground of parity. He placed on record two orders of the Hon'

ble Apex Court granting bail to the accused Nos. 1 and 2. According to him, the role played by the present applicant is lesser that those who have been granted bail by the Hon'ble Apex Court. The learned APP doesn't dispute this position. In view of the same, the application is allowed in terms of following order:

O R D E R

(i) The Bail Application is allowed.

(ii)The applicant be released on bail in connection with Crime No.0319/2019, registered with Pundlik Nagar, Aurangabad, District Aurangabad, for the offence punishable under Sections 120-B, 314, 203, 201 of the Indian Penal Code, on his executing P. R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety bond of the like amount.

(iii)The applicant shall not tamper with the prosecution evidence.
