Heard Mr. Chavan, learned counsel appearing for the applicant and Mr. Jagatkar, learned APP for the State. Perused the papers of investigation, including first information report as well as supplementary statement of the prosecutrix and papers relating to the T.I. parade.

Learned APP states that role of present applicant accused is that on 10.04.2017, one unknown 1/3

friend of the main accused Sudam Ghugre gave to the prosecutrix an amount of Rs.50/- and Mobile No. of Sudam Ghugre. The unknown friend of the main accused is identified by the applicant during the T.I. Parade.

On perusal of the first information report as well as supplementary statement of the prosecutrix, it appears that allegation of committing rape on prosecutrix on 10.04.2017, 11.04.2017 and 14.02017 are against the accused Sudam Ghugre, who, according to the prosecutrix, under the threat of showing conversion on mobile recording, has committed rape.

Considering the nature of allegation, no role is attributed to the present applicant in connection with the offence of rape. In such circumstance, the accused can be released on bail. Hence following order:

O R D E R

i.

The applicant shall be released on bail on his furnishing personal bond of Rs.10,000/-(Rupees 2/3

ten thousand) with one solvent surety of like amount.

ii.

The applicant shall not tamper with prosecution evidence in any manner.

Criminal application is disposed of.
