Heard the learned counsel for the applicant and the learned A.P.P. for the respondent-State.

The applicant is seeking bail in connection with Crime No. 376/2023, for the offences punishable under Sections 302, 384, 386, 387, 323, 504, 506, 507, 120-B, 75 r/w 34 of the Indian Penal Code and Sections 3(1)(i), 3(2) and 3(4) of the Maharashtra Control of Organized Crime Act (MCOCO Act), registered with Nagar Taluka Police Station District Ahmednagar. 3.
The applicant is seeking bail on the ground of parity to the order dated 19.09.2024 passed in Bail Application No. 1340/2024 (Ashok @ Sonu Vitthal Gund Vs. The State of Maharashtra) so also the order passed by the Hon'ble Supreme Court in case of accused-applicant Indrajeet s/o Ramesh Kasar (Petition for Special Leave to Appeal (Cri.) No. 4107/2025 dated 09.05.2025.

It is the case of the prosecution that the deceased was killed for ransom and the role attributable to the present applicant is that he is a conspirator. Similar role is attributed to Ashok @ Sonu Vitthal Gund, whose bail application was considered by this Court in Bail Application No. 1/3
1340/2024. The material evidence against the present applicant so also against Ashok is that there was telephonic conversation with Mr. Ravi Lokhande on 30.04.2023. Other than this evidence, there is no other evidence against the applicant.

The learned advocate for the applicant submits that though there are criminal antecedents against the applicant, but the main accused against whom there were similar antecedents has also been granted bail by the Supreme Court. Although MCOC proceeding was initiated against the applicant, considering the fact that 70 witnesses have been mentioned in the charge-sheet and even charge is yet not framed, there is no possibility of even trial commencing in near future. Therefore, considering the fact that another accused applicant in the said crime namely Ashok @ Sonu Vitthal Gund was granted bail by this Court in Bail Application No. 1340/2024 on 19.09.2024, so also applicant Indrajeet s/o Ramesh Kasar was granted bail by the Supreme Court in Petition(s) for Special Leave to Appeal (Cri.) No(s). 4107/2025, parity would apply to the present applicant. In view of the above, the applicant is entitled to be released on bail. 6.
In view of above, the application is allowed in the following terms :- a] The applicant shall be released on bail in connection with Crime No. 376/2023, for the offences punishable under Sections 302, 384, 386, 387, 323, 504, 506, 507, 120-B, 75 r/w 34 of the Indian Penal Code and Sections 3(1)(i), 3(2) and 3(4) of the Maharashtra Control of Organized Crime Act (MCOCO Act), registered with Nagar Taluka Police Station, District Ahmednagar, on furnishing PR bond of Rs.20,000/- (Rs. Fifty Thousand only) with one or two sureties in the like amount to the satisfaction of the trial Court. b] The applicant, upon being released on bail, shall not contact the informant, in any manner whatsoever, during the pendency of the trial.

c] The applicant shall co-operate with the trial Court and he shall attend each and every date, unless exempted by the trial Court, for reasons to be recorded in writing.
d] The applicant shall not tamper with the evidence of the prosecution and he shall not influence the informant, witnesses and other persons concerned with the case.
e] The applicant, upon being released on bail, shall place on record of the trial Court the details of his Contact Number and residential address with updates in case of any change. 6.
Needless to say, in case of violation of any of the aforesaid conditions, the bail granted to the applicant shall be liable to be cancelled. It is also clarified that the observations made in this order are limited to the disposal of the present bail application. The concerned Court shall proceed further in the matter without being influenced by the observations made hereinabove. 7.
The application stands disposed of.
