DATE: 1st October, 2018 PER COURT:- Heard learned Counsel appearing for the applicant and Shri S.V.Kulkarni, learned Counsel appearing for respondent No.1 Insurance Company. In view of the submissions made, the following order is passed:

ORDER

I) The applicant is permitted to withdraw 75% of the deposited amount alongwith interest accrued thereon, on submitting an undertaking to the satisfaction of Registrar (Judicial) of this Court.

II) Balance 25% of the amount alongwith interest accrued thereon be again invested in Fixed Deposit

{2} 53 CA 7790 OF 2012 & ORS. Receipt till decision in the appeal.

III) Civil Application No.7790 of 2012 stands disposed of.

IV) Place the First Appeals for further consideration on 11.10.2018.
