After having heard the learned Advocates for the parties extensively, when we expressed dis-inclination to grant any relief, learned Advocate for the petitioner/s thereupon, came around to urge for remand of the matter, on the ground that the petitioners have not been given personal hearing. According to him, so many questions have not been answered by the Scrutiny Committee. 2.

When we asked to learned AGP as to whether he has any objection for remanding matter, he was candid enough to concede

In view of that, the Writ Petition stands disposed of in terms of following order :

ORDER

i) Both the Petitions are allowed.

(ii) The order impugned herein is set aside.

(iii) The petitions be remanded back to the Scrutiny Committee to decide it afresh, after giving the petitioners a full fledged hearing.

(iv) We expect that the Scrutiny Committee shall decide the claims of the petitioners within 6 months from the receipt of the copy of this Court.

(v) The Scrutiny Committee shall decide the claim of the petitioners within a period of 6 months, from the date of receipt of copy of this Order and not to influence by any observations made herein.
