IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CRIMINAL WRIT PETITION NO. 762 OF 2015 Afzalkhan s/o Alamkhan Pathan ..PETITIONER

VERSUS

The State of Maharashtra & ors.

..RESPONDENTS Mr D.M. Shinde, Advocate for petitioner;

Ms R.P Gaur, Addl. Public Prosecutor for respondent no.1 CORAM : N.W. SAMBRE, J.

DATE : 3rd May, 2016 ORAL ORDER :

Having heard Mr Shinde, learned Counsel appearing on behalf of the petitioner, it is noted that the petitioner has suffered recovery warrant, pursuant to the provisions of section 125 (3) of the Code of Criminal Procedure.

2.

Learned Counsel has pressed into service procedural irregularity committed while issuing the said warrant.

3.

In my opinion, there is hardly any substance in the submission, as irregularity as could be noticed, cannot be inferred to be detrimental to the interest of the petitioner.

4.

In view of above, no case for interference is made out. Criminal Writ Petition stands dismissed.
