The applicant was granted anticipatory bail vide order dated 17th January, 2022 in Anticipatory Bail Application No. 1628 of 2021, by imposing a condition that the applicant shall not enter jurisdiction of village Pimpalwadi, Taluka - Karjat, District - Ahmednagar, till the conclusion of the Trial. The applicant seeks relaxation of the said condition on the ground that the applicant needs to cultivate his agricultural lands in Guts No. 171, 172/5 and 287 situated at Pimpalwadi and so as to look after the cultivation, he may be permitted to enter the village, by relaxing the condition.

Learned Additional Public Prosecutor, on instructions from

{2} criapln2008-22 the Investigating Officer, submits that the applicant has scrupulously followed the condition imposed on him. Charge sheet is filed in the matter on 27th January, 2022. The trial is yet to commence. The charge is yet not framed. The co-accused was granted bail by the Sessions Court, by imposing similar condition, however, the said condition is relaxed by the Sessions Court, by order dated 5th February, 2022. The applicant is, therefore, entitled for relaxation of the condition. 3.

The application is allowed. The condition imposed on the applicant that he shall not enter village Pimpalwadi, Taluka - Karjat, District - Ahmednagar till conclusion of the trial, is hereby relaxed. The applicant is permitted to enter village Pimpalwadi, however, he shall not influence the prosecution witnesses and he shall attend the concerned police station on every Sunday between 10.00 a.m. and 12.00 noon, till conclusion of the trial.
