Heard. Both these petitions are infructuous. The complaint of the petitioners was that the proposal of bifurcation of the District Central Co-operative Bank of Dhule district was not sent to the Reserve Bank of India, though it was proposed by the State Government. We saw the record and found that the proposal of the State
( 2 ) wp6738.05 Government for bifurcation was first examined by the National Bank and as per section 23(4A) of the Banking Regulation Act, 1949, the National Bank made its comments on proposal and sent the same for further decision to Reserve Bank of India. The National Bank examined the case of bifurcation and made adverse comments on it. The Reserve Bank of India, therefore, did not allow the bifurcation. The petitioners cannot make grievance in respect of the decisions taken by the National Bank and Reserve Bank of India. These decisions were made on the basis of facts and figures. The Court would not sit in judgment over such decisions. The petitioners are free to make fresh request to the Government for bifurcation or establishment of new District Central Co-operative Bank for Nandurbar district.

The writ petitions are disposed of as infructuous. Rule discharged. No costs.
