Mr. Patil, the learned counsel for the petitioner submits that, the show cause notice is issued stating that the petitioner has erroneously claimed to belong to disable category. The petitioner is disabled and has 60% low vision and is issued with the permanent disability certificate. The permanent disability certificate issued by the Board is at Exhibit - B and same states that, the percentage of permanent blindness of the petitioner is 60%. The petitioner has not made a false claim of disability. The said certificate is also submitted online.

The respondents have issued show cause notice to the

2 wp 6154.18 petitioner. Mr. Pawar, the learned counsel for respondent Nos. 1 and 2 submits that, the petitioner can file reply to the show cause notice along with all the documents she relies. It is submitted that, reply is already filed by the petitioner. 3.

The petitioner may immediately file supporting documents on which she relies claiming disability. Needless to state the Chief Executive Officer shall consider the documents filed by the petitioner and the explanation given while taking the decision. The writ petition is accordingly disposed of. No costs. 4.

If any adverse order is passed, the petitioner has got liberty to challenge the same.
