It appears from the record that notices were served to respondents No. 1 and 2. When the matter is called out none appears for both respondents. The matter pertains to condonation of delay. In view of the nature of subject matter, I prefer to proceed further for adjudication of present application on merit, which is pending since 2010 in absence of both respondents.
Heard learned AGP for the applicant- State of Maharashtra. 3.
Perused the application and relevant documents on record. The matter pertains to condonation of delay. It has been submitted that the delay is not intentional or deliberate but it caused due to official process. For the reasons mentioned in the application, there is no impediment to allow the application for condonation of delay. Accordingly application stands allowed in terms of prayer clause "B". The delay caused in filing the appeal against the impugned judgment and award passed by learned Reference Court is hereby condoned.
2 51-CA-10167-10 Registry to take requisite steps for further process. The civil application stands disposed of.

On registration of appeal, issue notice of admission to respondents, returnable on 19-12-2017.
