DATED : 2 nd July, 2015 PER COURT :- 1] At the out set, Shri C.R.Thorat, learned counsel for the applicants submits that he has instructions to withdraw the application on behalf of applicant no. 1-Dadarao and applicant no.3-Subhash. He submits that liberty be granted to these applicants to file the bail application afresh before the learned trial court after filing of the charge sheet. Prayer accepted.

2] In so far as applicant no.2-Bhausaheb is concerned, he is the father-in-law of deceased Pooja. The first information report is lodged by Lahu Shinde, who is the father of deceased Pooja. The first information report shows that in respect of demand the allegations are against every member of the family. However, first information report clearly shows that Rs.40,000/- were given to husband Dadarao. The allegations against Bhausaheb, who is fatherin-law are most general in nature. Bhausaheb is arrested on 5.5.2015 and since then he is in jail.

3] Learned Additional Public Prosecutor submits that the investigation is almost over and there is likelihood of filing of

crap3120.15 charge sheet in near future. Looking to the said aspect that the investigation is over, the applicant Bhausaheb, who is the father-in-law, against whom allegations are general in nature, can be released on bail. That leads me to pass following order.

O R D E R

(i) Criminal Application of applicant no. 1Dadarao and applicant no.3-Subhash is hereby dismissed as withdrawn with liberty to these two applicants to file application for bail afresh before the learned trial court after filing of the charge sheet.

(ii) Criminal Application of applicant no.2Bhausaheb is allowed. He be released on bail on he executing P.R. bond of Rs.10,000/- with one solvent surety in the like amount, in connection with Crime No. 69 of 2015, registered at Phulambri police station, District Aurangabad, for the offences punishable under Sections 498-A, 304-B r/w 34 of the Indian Penal Code and under Sections 4, 5 of the Prohibition of Dowry Act. (iii) Bail before the trial court.

(iv) Application is disposed of.
