Heard learned Counsel for the parties. Learned Counsel for the petitioners unconditionally withdraws the averments / allegations made against the Presiding Officer of the Industrial Court, Aurangabad.

Presiding Officer, Industrial Court has vide his order dated 7.10.2020 directed the complainants to follow proper procedure for transfer of complaint to some other Court. In view of the allegations have been withdrawn unconditionally, order given in Writ Petition No. 7432 of

2 48 wp-7432-20+1 2020 is set aside. So far as regards the order under challenge in Writ Petition No. 6544 of 2020 is concerned, the learned Counsel came around to submit that the Industrial Court may be requested to decide the interim application on its own merits keeping all the contentions open.

In view of above submission, the learned Member, Industrial Court, Aurangabad is requested to hear Complaint (ULP) No. 86/2020 and interim applications moved therein on its own merits. Considering the nature of dispute, the Industrial Court is expected to decide the matter at the earliest. It is informed that the matter has been kept for 6.3.2021. Learned Presiding Officer, Industrial Court may do well to prepone the matter to 8.2.2021. Parties to appear before Industrial Court on 8.2.2021.
