The non-Applicant though served, none appears. The Applicant has sought transfer of proceedings bearing Hindu Marriage Petition No.435 of 2014 (Nitin Bhalchandra Maslekar Vs. Purva Nitin Maslekar) pending on the file of Family Court, Pune to Family Court, Aurangabad. The ground of hardship is pressed into service as the Applicant, lady, is residing at Aurangabad alongwith her parents and minor child. The non-Applicant, though served, he and his Advocate are absent. The matter was also adjourned on the last occasion for the same reason. Today, the matter is part heard. In view of the fact that the Applicant - wife is residing at Aurangabad alongwith her minor child, it will be appropriate, in my opinion, to allow the application in terms of prayer clause (B) as the Applicant will suffer more hardship.
