This is an application for bail under Section 439 of Code of Criminal Procedure. The applicant has been arrested in connection with Crime No. 16 of 2022 registered with Fardapur Police Station, Dist. Aurangabad for the offences punishable under Sections 395, 397, 347, 427, 412 and 201 of the Indian Penal Code.

Heard. Considered the submissions advanced. Perused the First Information Report ("F.I.R.") and related police papers. 3.
Without going into merits of the matter, suffice it to say that all the co-accused have been granted bail. The present applicant, therefore, deserves to be enlarged on bail. He has been behind the bars since 03rd 1 / 2
937-BA-889-22.odt March, 2022. On investigation of the crime, charge-sheet has been filed. It will take time for commencement and conclusion of the trial. It is only post registration of crime, the applicant came to be arrested/taken into custody. There were no other criminal charges levied against him before the one in question. Be that as it may.

In view of above, the application deserves to be allowed. Hence I pass the following order :-
ORDER
(I) The bail application is allowed.
(II) The applicant be released, in connection with Crime No. 16 of 2022 registered with Fardapur Police Station, Dist. Aurangabad for the offences punishable under Sections 395, 397, 347, 427, 412 and 201 of the Indian Penal Code, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount.
(III) The applicant shall mark his presence in the concerned police station on the first day of every month between 12.00 noon to 01.00 p.m. till conclusion of trial.
(IV) The applicant shall not tamper with the prosecution evidence.
