Perused record and proceeding. The office note indicates that notice issued to sole respondent Pandurang Bajirao Shinde returned unserved due to his death. The bailiff report filed on record clearly indicates that respondent Pandurang Shinde died on 29/01/2011. A copy of death certificate is filed on record. Thereafter no steps have been taken by the appellants to bring on record L.Rs. of deceased respondent. None is present on behalf of the appellants. About four chances have been given to the appellants for taking steps. In view of the above, it appears that the appellants are not really interested in taking steps and to remove the objection. In the result, I pass following order.

ORDER

The appeal against sole respondent Pandurang Bajirao Shinde stands abated.
