DATED : 3rd July, 2015 PER COURT :- 1] This is an application for anticipatory bail, since the applicants are apprehending their arrest in connection with Crime No. 13 of 2015, registered at Upanagar Police Station, District Nandurbar, for the offences punishable under Sections 406, 420, 506 r/w 34 of the Indian Penal Code. 2] I have heard Shri A.S.Savale, learned counsel for the applicants; Shri U.S.Mote, A.P.P. for respondent/State and Shri S.S.Jadhav, learned counsel for first informant. 3] At the out set, learned counsel Shri A.S.Savale submits that he has instructions to withdraw the application for applicant no.1-Ejajbhai Ayyubhai Tai and applicant no.2Mushrrafbhai Ahmadbhai. In that view of the matter, their application for anticipatory bail is dismissed as withdrawn. 4] So far as applicant no.3-Altaf Dadubhai Sheikh is concerned, from the first information report, it is clear that no allegations are made against applicant no.3. Even the learned Additional Public Prosecutor and the learned counsel for the first informant has fairly stated that there are no

crap3134.15 allegations whatsoever against applicant no.3. Further, even till today during the course of the investigation also no role is ascribed to applicant no.3. In that view of the matter anticipatory bail can be granted to applicant no.3. That leads me to pass following order.

O R D E R

(i) Criminal Application is allowed.

(ii) Application of applicant no.1-Ejajbhai Ayyubhai Tai and applicant no.2-Mushrrafbhai Ahmadbhai is dismissed as withdrawn.

(iii) Application of applicant no.3-Altaf Dadubhai Sheikh is allowed.

(iv) In the event of his arrest, in connection with Crime No. 13 of 2015, registered at Upanagar Police Station, District Nandurbar, for the offences punisahble under Sections 406, 420, 506 r/w 34 of the Indian Penal Code, applicant no.3-Altaf Dadubhai Sheikh be released on anticipatory bail on he executing P.R. bond of Rs.10,000/- with one solvent surety in the like amount.

(v) Application is disposed of.
