IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD 23 CIVIL APPLICATION NO. 2847 OF 2021 IN FAST/16108/2020 MADHAV MURLIDHAR GORE

VERSUS

STATE OF MAHARASHTRA AND ANR ...

Advocate for Applicant : Ms. Mrunal Ahdhare h/f Mr. Kale Ajeet B.

AGP for Respondents: Ms. R.R. Tandale Advocate for Respondent No. 2 : Ms.Manjushri V. Narwade. ...

CORAM : S. G. MEHARE, J.

DATE : 06th MARCH,2024 PER COURT :

1.

Since the day of filing of the First Appeal, the deficit Court fee has not been deposited. This Court by order dated 25.10.2023 had directed the applicant to deposit deficit Court fee within four weeks. The applicant did not pay heed to the Court's order and the matter remained un-attended by the office of the counsel for the applicant. The Court fee was to be deposited in the year 2020. However, it was not deposited. The Court fee is a Government revenue. The delayed recovery of the Government revenue sustains loss to the Government. Be that

23ca2847.21 as it may, the applicant is not diligent in taking steps for complying with the Court's orders. Today again the learned counsel for the applicant submitted that the Court may grant him time to deposit court fee. The Court did not find any reason to accept the request to extend the time.

2.

Considering the conduct of the appellant/applicant, the Court cannot extend further time to pay the Court fee. There are many matters lying before this Court under objection for payment of deficit Court fee. Even after passing orders by the Court the orders have not been complied with. Such a defiance of the Court's order is un tolerable for the reason that a bad habit is developed in the Country and that is reducing the importance of the Courts and its orders. For the reasons, a request for grant of further period of two weeks time to pay Court fee has been refused and the application stands dismissed for non payment of the deficit Court fee. ( S. G.
