Heard Mr. Gaikwad, learned counsel for the applicant and Mr. Lokhande, learned APP for the State. Perused the papers of investigation.

This application is filed under section 439 of the Criminal Procedure Code, seeking bail in Crime No.195/2016 registered with Pallam Police Station, Dist. Parbhani for the offences punishable under sections 143, 147, 148, 149, 341, 329, 504 of the Indian Penal Code, section 4/25 of the Indian 1/3

Arms Act and section 135 of the Mumbai Police Act. 3.

It is alleged that the present applicant and other accused persons in the crime namely, Vijay Sudam Kamble and Balu Maroti Kamble have assaulted the informant with the help of iron road on his waist, leg, left hand. They also snatched an amount of Rs.25,000/- from the pocket of the informant. 4.

The complainant has alleged that the present applicants and other accused persons have jointly snatched an amount of Rs.25,000/- from his pocket and they have also assaulted him by means of iron rod. No specific act of the present applicant has been stated. Furthermore, during investigation accused was arrested on 06.05.2017 and on the same day he was remanded to MCR.

From the papers of investigation, it appears that practically, the investigation is over. Considering the nature of allegations and the fact that other accused persons in the crime are already released on anticipatory bail by this Court today, I am of the opinion that applicant is entitled to 2/3

be released on bail. Hence the application is allowed.

The applicant shall be released on bail in connection with Crime No.195/2016 registered with Pallam Police Station, Dist. Parbhani, on his executing P.R. Bond of Rs. 25,000/- [Rs. Twenty five thousand only] with one solvent surety in the like amount.

7.

Applicant shall not tamper with the prosecution evidence in any manner.
