Heard learned counsel for the petitioner, learned AGP for State and the counsel for respondents, who are ad idem to set aside the impugned orders dated 02.06.2021 and 01.10.2019. 2.

Learned AGP makes a statement that if the matter is remanded, the authorities concerned will give an opportunity to the petitioner and the respondents and thereafter will pass an order in accordance with law.

As such, the aforesaid impugned orders are set aside. The matter is remanded to the Tahsildar, Erandol, Dist. Jalgaon. 4.

The parties shall appear before the Tahsildar on 13.06.2022. The Tahsildar, after giving an opportunity to the respective parties, pass an order in accordance with law without SG Punde

2 904WP8277.2021 getting influenced by the orders passed earlier in the matter. The parties shall cooperate with the Tahsildar in getting the matter decided without seeking adjournments.

The Tahsildar shall decide the Wahiwat Application No. 3/2019 within a period of fifteen (15) days from the date of concluding the arguments.

In case any revision is preferred before the next authority i.e. SDO, he shall also after affording due opportunities to the respective parties, decide the revision in accordance with law thereafter, within a period of one month.

It is made clear that this Court has not expressed any opinion on the merits of the case.

Petition stands disposed off in the above terms with no order as to costs.
