This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicants have been arrested in connection with Crime No.0080/2022, registered with Ambhora Police Station, District Beed, for the offences punishable under Sections 109, 307, 353, 332, 333, 143, 148, 149, 427 of the Indian Penal Code.

Heard.
Perused the First Information Report (FIR) and the related police papers.

The learned APP would submit that the applicants were arrested on the spot. They have assaulted the police officials who had been there in discharge of their official duties. Investigation of the crime is still underway. He, therefore, urged for rejection of the application.

Considered the submissions. Perused the FIR. The applicant Nos. 2 to 4 have not been named in the FIR. As such, no overt act has been attributed to them. So far as regards applicant No.1 - Dnyaneshwar is concerned, he is alleged to have instigated to his son and others to beat up the police personnel. Applicant No.1 is 70 years of age. All the applicants are behind the bars for about two months. Considering no overt act has been attributed to anyone of them, their application is allowed in terms of following order:
O R D E R
(i) The Bail Application is allowed.
(( 3 )) 945-BA-893-2022 (ii)The applicants shall be released on bail in connection with Crime No.0080/2022, registered with Ambhora Police Station, District Beed, for the offence punishable under Sections 109, 307, 353, 332, 333, 143, 148, 149, 427 of the Indian Penal Code, on their executing P. R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) each with surety bond each of the like amount.
(iii)The applicants shall attend the concerned police station as and when required.
(iv)The applicants shall not tamper with the prosecution evidence.
