Though the petitioner has stated in paragraph 16 that no appeal is pending before any authority as regards the cause of action, it is informed that an appeal is pending before the Divisional Commissioner, Nashik. So also, the prayer is put forth in clause D that the appeal filed on 03.06.2022 be decided expeditiously.

In view of the above, this Writ Petition is disposed off with the following directions :- (a) Respondent No.2 shall dispense with the issuance of

*2* 907wp6331o22 notice as the contesting parties viz. the petitioner herein and respondent Nos.3 and 4 are put to notice that they shall appear before respondent No.2 on 28.06.2022 at 12:00 noon. (b) The petitioner is at liberty to submit a written justification in support of his request.

(c) Since the procedure for transfer of employees is to be concluded by 30.06.2022, we would request respondent No.2 to pass an order as expeditiously as possible and in the event, he calls upon the Zilla Parishad to consider the request of the petitioner, the Zilla Parishad would consider the said request within the framework of the policy/ rules applicable. kps (ANIL L.
