This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0136/2022, registered with Parbhani Rural Police Station, District Parbhani, for the offences punishable under Sections 379, 430, 431, 432, 439, 109 r/w 34 of the Indian Penal Code and under Sections 48(7), 48(8) of the Maharashtra Land Revenue Code and under Sections 3, 15(1), 15(2) of the Environment Protection Act and under Sections 37(1) and 135 of the Maharashtra Police Act.

Heard. Perused the First Information Report (FIR) and the related papers.

The applicant is behind the bars for over about 58 days. He has no criminal antecedents. The co-accused have been granted bail. Considering the nature of offence and the fact that the co-accused having been granted bail and the applicant to have been behind the bars for 58 days, the application is allowed in terms of following order:
O R D E R
(i) The Bail Application is allowed.
(ii) The applicant be released on bail in connection with Crime No.0136/2022, registered with Parbhani Rural Police Station, District Parbhani, for the offences punishable under Sections 379, 430, 431, 432, 439, 109 r/w 34 of the Indian Penal Code and under Sections 48(7), 48(8) of the Maharashtra Land Revenue Code and under Sections 3, 15(1), 15(2) of the Environment Protection Act and under Sections 37(1) and 135 of the Maharashtra Police Act, on his executing P. R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety bond of the like amount.
