By this petition, petitioners challenge order dated 28.03.2022 passed by the 10th Jt. Judge, Civil Judge, Senior Division, Aurangabad allowing the application for marking the surrender deed as an exhibit. The trial court has observed that neither signature nor contents of the surrender deed have been proved. The necessary consequence is that the document will not be read in evidence. The same has been marked only for the purpose of identification as the same was shown to a witness during his cross-examination. Since the document will not be read in evidence, there is no cause for petitioners to file present writ petition. 2.

The writ petition is devoid of merits and the same is dismissed without any orders as to costs.
