The applicant / accused in Crime No.

14/2016, for offences punishable under Sections 436, 504 and 506 of the Indian Penal Code, registered with Police Station, Tadkalas, District Parbhani, by this application is seeking release on bail after filing of the charge-sheet.

Heard the learned Counsel for the applicant as well as the learned Addl. Public Prosecutor for the respondent.

The learned Addl. Public Prosecutor opposed the application by contending that in past also, the applicant had indulged in similar conduct.

Perused papers of investigation made available. According to the prosecution case, the present applicant, on 29.01.2016, had set house of her aunt - informant Parwatibai Kadam on fire thereby causing loss of about Rs. 35,000/- to her aunt. 5.

Now, investigation of the crime, in question, is over and charge-sheet has been filed. The trial will take its own time. So far as criminal antecedents of the present applicant are concerned, care thereof can be taken by imposing appropriate conditions. It needs to mention here that in R.C.C. No. 730 of 2013, registered at the instance of the present informant, the applicant is already acquitted.

Hence, the following order :- (a) The application is allowed.

(b) The applicant / accused, in the above crime, be

(3) Cri. Appln. No. 2972 of 2016 released on bail on his executing P.R. Bond in the sum of Rs. 20,000/- and one or more solvent sureties of the like amount.

(c) As a condition of this order, the applicant shall not enter into the territorial jurisdiction of Police Station, Tadkalas, District Parbhani, till disposal of trial arising out of Crime No. 14/2016.

(d) The applicant shall not, directly or indirectly, make any inducement, threat or promise to any persons acquainted with the facts of the case so as to dissuade them from disclosing such facts either to the Court or to any police officer.

(e) The applicant shall not tamper with the prosecution evidence in any manner and shall cooperate the learned trial Judge in expeditious disposal of the trial.

(f) The applicant shall not repeat commission of similar type of offences in future.

The Application stands disposed of in the aforesaid terms.
