I have heard the learned Advocate appearing for the parties, briefly. Issue is that the learned Deputy Charity Commissioner, Latur disposed of an application Exh. 2 filed by the petitioner under Section 22 of the Maharashtra Public Trust Act, 1950. The authority below has disposed of the application by concluding that no Order can be passed on such an application until all the litigating sides are heard.

The learned Advocates of the respective sides in
2 24 wp7377-19 this matter submit that this Court may post the matter on a particular date before the learned Deputy Charity Commissioner and all the parties would advance their arguments on application Exh. 2 who can then pass an Order on its own merits.

By considering the consensus, the petition is disposed off. The Order dated 22.5.2009 stands set aside and application Exh. 2 is restored to the file of the learned Deputy Charity Commissioner, Latur. All the litigating parties consent to appear before the authority on 17.7.2019 for advancing arguments on application Exh.
2. Needless to state that the learned Court would consider the contentions of he parties and pass an Order on the merits of the application.
