The grievance of the petitioner is against rejection of approval to the petitioner's appointment by Respondent No.3- Education Officer (Secondary), Zilla Parishad, Nanded by communication dated 23.06.2021.

The petitioner has relied upon the order passed by this Court on 26.11.2025 in Writ Petition No.11495 of 2022 (Dnyaneshwar Pralhand Chikane Vs. The State of Maharashtra). This Court by considering the Government Resolution dated 06.02.20212, 23.06.2017, 20.06.2018 and the ban imposed by the Government Resolution dated 04.05.2020 during the period of Covid-19, partly allowed the said Writ Petition. Considering the order, both Advocates agree that the present case is covered by the said order. In view of the same, the following order is passed :- Narwade/

i.
Writ Petition is allowed partly.
ii.
The impugned communication passed by Respondent No.- Education Officer (Secondary), Nanded is quashed and set aside. iii.
Respondent No.3-Education Officer to consider the proposal and decide the same on its own merits.
iv.
The parties are at liberty to produce before the Education Officer relevant documents, case laws or the Government Resolutions, if any within a period of two weeks from today.
v.
The decision shall be taken within a period of eight weeks from today. The Education Officer shall not reject the proposal for the reasons which are already assigned in the impugned communication. vi.
