Mr. S. G. Kawade states that he has instructions to appear on behalf of Respondent No.2. He tendered across the bar 'Vakalatnama'. The same is taken on record.

At the outset, learned Counsel for the Applicant states that considering the pendency before this Court there is no possibility of present Appeal be taken up for hearing in short time. He, therefore, seeks confirmation of interim relief.

Learned Counsel for the Respondent No. 2 and learned APP opposed the application by contending that considering serious nature of offence it is not fit

There is substance in the contention of learned Counsel for the Applicant that if the Applicant is directed to undergo the sentence then appeal will become infructuous. Hence, the Application is allowed by confirming interim order dated 05th June, 2023. (R.M. JOSHI, J.) Malani
