By this civil application, the applicant is seeking relief in the nature of a direction to Respondent No. 3, not to give any appointment on compassionate basis in the Cantonment Board. 2.

In the reply affidavit, Respondent No. 3 has placed on record a copy of Cantonment Board Resolution No.9 dated 29.01.2025, whereby, one Pushpa Sunil Bhange has been appointed on compassionate ground on the post of Safai Karmachari. 3.

The said resolution refers to guidelines issued by the Ministry of Defence on 19.01.2018 pertaining to 100 points scale weightage system for considering the claims of persons seeking compassionate appointment and on that basis, the said Pushpa Sunil Bhange had been granted appointment on compassionate ground.

The learned counsel for the applicant/petitioner submits that in the said Resolution of the Cantonment Board dated 29.01.2025 itself, the name of the applicant is placed at Serial No.2, while the said Pushpa Sunil Bhange is at Serial No.15. But, it is submitted on behalf of Respondent No.3 that after applying the said guidelines issued by the Ministry of Defence, points were allotted to all the candidates and on that basis Pushpa Sunil Bhange was awarded 81 points and placed at Serial No.1, while the applicant was at Serial No. 8 with 48 points. 5.

In our opinion, if the applicant/petitioner is aggrieved by the said basis on which Pushpa Sunil Bhange has been appointed, he would be at liberty to challenge the same, either by way of an independent proceeding or by seeking amendment in the pending writ petition. No relief can be granted in the present application. 6.
