I have heard the learned Advocates for the applicant-husband and respondent-wife.

The applicant-husband has preferred proceedings for divorce under Section 13(1)(1-A) of the Hindu Marriage Act, 1955 before the learned Civil Judge Senior Division, Vaijapur which was subsequently transferred to the Court of the learned Civil Judge Senior Division, Aurangabad and renumbered as H.M.P. No.69/2017. Respondent-wife has preferred a petition No.A-212/2017 seeking restitution of conjugal rights

MCA_136_2018 before the learned Principal Judge, Family Court, Aurangabad. It is submitted by the respondent-wife that the proceedings preferred by the petitioner before the District Court could be transferred to the Court of the learned Principal Judge, Family Court, so that both the proceedings instituted by the husband and the wife respectively can be taken up by the same Court.

In view of the above, this application is partly allowed. H.M.P. No.69/2017 along with Civil M.A. No.99/2017 pending before the learned C.J.S.D. and the learned Principal District & Sessions Court, respectively be transferred to the Court of the learned Principal Judge, Family Court, Aurangabad.

The litigating sides shall appear before the Family Court on 21.11.2018. Both are at liberty to request the Family Court to post these two matters along with petition No.A-212 of 2017 on common dates, so that the litigating sides would find it convenient to conduct these three cases on same dates.
