Heard learned Counsel for the applicant-wife who is seeking transfer of HMP No. 796 of 2020 pending in the Court of Civil Judge, Senior Division, Pune to the Court of Civil Judge, Senior Division, Nilanga, District Latur.

The Respondent-husband, despite service, did not care to appear before this Court. It is pointed out that applicant-wife has fled two proceedings in the Court at Nilanga, one is for grant of maintenance under Section 125 Code of Criminal Procedure and another under the provisions of Protection of Women from Domestic Violence Act, 2005. The Respondent-husband has also appeared in these proceedings but to counter the same, he has fled HMP No. 796 of 2020 at Pune for getting divorce.

(i) Misc. Civil Application is hereby allowed and HMP No. 796 of 2020, pending in the Court of Civil Judge, Senior Division, Pune, is hereby transferred to the Court of Civil Judge, Senior Division, Nilanga, District Latur.
