Mr. Patil, the learned counsel for the petitioner submits that, the proposal seeking verification of the caste claim of the petitioner is pending since August 2015. The petitioner is elected as a Member of Gram Panchayat. The Collector has issued notice for disqualification on the ground that validity certificate is not submitted within six months.

We have also heard the learned Assistant Government Pleader for respondents/State.

In view of the fact that, validation proceeding in respect of

2 wp 6969.17 caste claim of the petitioner is pending with the Committee, we pass following order.

The Committee shall decide the validation proceeding in respect of caste claim of the petitioner expeditiously and preferably within a period of six (06) months from today. The petitioner shall co-operate in expeditious disposal of the said proceedings. The petitioner shall appear before the Committee on 16th November, 2017.

The petitioner may bring to the notice of the authority/Collector, the order of the Apex Court staying the judgment of the Full Bench of this Court in a case of Anant H. Ulahalkar and another Vs. Chief Election Commissioner and others reported in 2017(1) Mh. L. J. 431, which certainly is required to be considered by the authority. The writ petition accordingly is disposed of. No costs. [SMT.
