We have considered the submissions of the learned Advocate for the Petitioner and the learned AGP. The Petitioner obtained a Thakur ST certificate on 18.12.2020. On 19.01.2021, she was elected as a Member of the Gram Panchayat. On 12.02.2021, she was elected as a Sarpanch. The State Government extended time upto 17.01.2023 for tendering validity certificates. 2.

The Law laid down by the learned Full Bench of this Court in Anant H.Ulahalkar Vs. Chief Election Commissioner [2017(1) Mh.L.J. khs/June 2023/6381

ble Supreme Court in Shankar Raghunath Devre (Patil) Vs. State of Maharashtra and others [SLP (C) No.29967/2016 and other connected matters, dated 23/08/2018], would apply to the case of the Petitioner. 3.

The learned Advocate for the Petitioner submits on instructions that the Petitioner would not press for any relief in the light of the above, save and except, a direction to the competent Caste/Tribe Scrutiny Committee to decide the claim of the Petitioner at the earliest. 4.

The learned AGP submits that the Petitioner can appear on 27.06.2023. The constitution of the Committee has undergone a change. Thereafter, prior to 15.07.2023, a final order would be passed. 5.

In view of the above and by recording the above statement, this petition is disposed off. The Petitioner would appear before the competent Committee at 12.00 noon on 27.06.2023. Written notes of submissions are permitted.
