IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 7469 OF 2017 Smt. Premla Gangaram Sunkwad

...Petitioner

vs.

State of Maharashtra and Ors.

...Respondents

Mr.A.N. Nagargoje for the Petitioner.

MR. A.R. Kale, AGP for the Respondent State. CORAM : SHANTANU KEMKAR & NITIN W. SAMBRE, JJ.

AUGUST 18, 2017 P.C.:

Aggrieved by the order dated 12.5.2017 Exh. "E" by which the petitioner has been transferred from Nanded to Mahur and the subsequent order of rejection of her representation against the said transfer order, the petitioner has filed this petition. 2.

Learned counsel for the petitioner submits that after passing of the impugned transfer order, one Assistant Account Officer stood retired and in the circumstances, petitioner's case deserves to be considered sympathetically.

3.

Learned counsel for the respondent on.2 submits that the petitioner has completed almost 9 years and 6 months at her present place of posting and there is no violation of transfer policy in transferring the petitioner from Nanded to Mahur. 4.

Be that as it may, we are inclined to dispose of this petition

hvn by directing respondent no.2 to consider the petitioner's representation for accommodating her in the place of person who has already retired, if possible.

5.

In the circumstances, without commenting upon the merits of the matter, we dispose of this petition by directing respondent no.2 to consider the petitioner's prayer for cancellation of transfer order and to accommodate her at the place of the employee who has retired, if possible. The decision to that effect be taken as expeditiously as possible but not latter than six weeks from the date of receipt of copy of this order. 5.

With the aforesaid directions, petition is disposed of. (NITIN W. SAMBRE, J.) (SHANTANU S. KEMKAR, J.)
