This Court had issued notice to the nonapplicants on 07.09.2018. The non-applicants are served.

We have heard the learned counsel for respective parties.

The present applicant seeks restoration of the writ petition dismissed for non-prosecution. 4.

Mr. Jadhav, learned counsel for the applicant submits that he could not inadvertently look into the matter and the order was passed. As he could not look into the matter, the matter was

It is trite that, for the fault of the Advocate, the litigant should not suffer.

Considering the nature of the matter and the reasons stated in the application, civil application is allowed in terms of prayer Clauses (B) and (C). The applicant shall work out the matter on the next date.

Civil Application is disposed of.
